Symantec Lawsuit delaying Vista?

Quote:
Symantec has filed suit against Microsoft, accusing the latter of intellectual property theft and breach of contract related to data-storage technology.

The lawsuit, filed in the US, seeks unspecified damages and a halt to the development of Windows Vista, claiming that Microsoft is wrongfully incorporating Veritas storage technology into its next-generation OS.

The case relates to a 1996 contract between Microsoft and Veritas, where the former licensed a "light" version of Volume Manager from Veritas and used it in Windows 2000; and later used the solution to develop Windows Server 2003.

Symantec further charges that Microsoft has used the technology to develop Windows Vista and Longhorn Server.

Symantec also claims that Microsoft has improperly included its intellectual property in Windows Vista, and seeks an injunction that would block the further development, sale, or distribution of Vista and other products until all Symantec intellectual property is removed.

According to the complaint, Microsoft's pervasive and continuing disregard of Symantec's intellectual property and contract rights has irreparably harmed Symantec, and constitutes trade secret misappropriation.

Moreover, Microsoft is now incorporating Symantec's IP into the upcoming Vista and Longhorn Server products, which is why Symantec is asking for an injunction against the release of those two products.

Meanwhile, in a statement, Microsoft stated that it has worked hard to try and resolve the dispute and that it has acted within its rights in the contract. They are confidant that their actions are wholly consistent with the legal agreements between Veritas and Microsoft, and that any claims to the contrary will eventually be shown to be without merit.

However, this lawsuit filed by Symantec could mean yet another complication for Microsoft in its efforts to release the much anticipated but often-delayed Vista operating system next year.

Here's a prediction that Microsoft buys out symantec lol

Ah ... the essence of Microsoft is back! At least Bill Gates passed down his "tactics" well to his newbies!
